Medical malpractice is the act in which a doctor, surgeon, or other licensed healthcare provider acts negligently, causing injury or death in a patient. Patients expect a timely diagnosis of a medical problem along with proper treatment. In some cases a delay in diagnosis may have serious consequences to the patient and may affect their quality of life. If you or a loved one has been injured as a result of a medical error or medical negligence contact a New York Medical Malpractice Attorney immediately.

Medical malpractice is considered an epidemic that continues to spread in the United States today. Here are some U.S. medical malpractice statistics:

  • Every year there are more deaths as a result of medical errors than AIDS, breast cancer, and auto accidents combined.
  • Every year over 1.3 million people are injured due to medication errors.
  • Every year up to 98,000 people may die in hospitals from medical errors.
  • Healthcare providers, including, doctors, chiropractors, dentists, nurses, and hospitals need to be held accountable for the pain and suffering that they create after performing medical malpractice or medical negligence. The New York Medical Malpractice attorneys at Wingate, Russotti & Shapiro have the legal knowledge and unending dedication to assist you in your New York medical malpractice claim.

In one case, our firm obtained an $8.5 million verdict for a 62 year-old man who suffered a stroke following a delay in surgery and discontinuance of his prescription of Heparin, a drug which prevents blood clotting. Following his stroke, which could have been avoided with timely surgery, the plaintiff was confined to a wheelchair and was left virtually unable to speak. With the subsequent settlement proceeds, the plaintiff bought a new home designed and equipped specifically to enable him to care for himself. This was one of the largest medical malpractice verdicts ever in Westchester County. (Click here to read more about this case.)

In another medical malpractice case, partner Philip Russotti obtained the highest verdict in any personal injury case in Putnam County. The plaintiff claimed that the defendant, an orthopedic surgeon, failed to take a biopsy before performing surgery to remove a suspected Baker's cyst. The defendant proceeded with surgery despite signs on MRI that the growth might be malignant and a recommendation from the non-party radiologist that a biopsy be performed. The plaintiff required an above-the-knee amputation which involved the removal of most of the right femur. The jury found that the defendant deviated from acceptable medical practice and awarded the plaintiff over $6.2 Million in damages. (Click here to read more about this case.)

In a recent case, Jason Rubin obtained a recovery of $2.95 Million on behalf of two sisters whose mother died as a result of medical malpractice. (Click here to read more about this case.)
