$275,000 Medical Malpractice Verdict in New York

We try cases all over the state. WRS attorney, Jason Rubin, recently obtained a $275,000 settlement in a medical malpractice action after a week long trial in Chenango County. Our client, a 45 year old woman who sustained a bladder rupture while undergoing a cystoscopy with hydro-distention, a procedure where the bladder lining is examined while the bladder is over distended with water in order to look for evidence of a condition known as interstitial cystitis.

During the trial, Jason demonstrated that the cystoscopy with hydro-distention was contraindicated and unnecessary because the plaintiff's symptoms were inconsistent with interstitial cystitis, and other potential causes of her symptoms were not adequately ruled out. Jason also proved that the procedure, an excessive amount of water was allowed into the bladder, contributing to the rupture.

As a result of the bladder rupture, plaintiff developed a pelvic abscess, requiring three attempts to drain and approximately one month of hospitalization. Additionally, she suffered from an inability to void, urinary retention and urinary incontinence.

We are proud to add that the trial Judge commented that Jason's cross-examinations of the defendant urologist were "great" and "impressive". We believe this contributed to the substantial settlement in a county not know for its generosity to plaintiffs in malpractice actions.
